Agreement to these terms
By accessing or purchasing from davidsides.com, you agree to these Terms of Service. If you do not agree, please do not use our store.
Products
We sell digital sheet music arrangements as downloadable PDF files. All products are for personal, non-commercial use only unless otherwise stated.
Digital downloads
All sales of digital products are final. Because digital files are delivered immediately upon purchase and cannot be returned, we do not offer refunds on completed purchases except in the circumstances described below.
Refund policy
We will issue a refund if:
- The file you received is corrupted or unreadable
- You were charged for an item you did not receive
- You were charged twice for the same item
To request a refund, email david@davidsides.com within 14 days of purchase with your order number and a description of the issue. We will respond within 3 business days.
We do not issue refunds for change of mind, accidental purchases, or because the arrangement did not meet your personal expectations after download.
Intellectual property and permitted use
Your licence to use our sheet music
When you purchase a sheet music arrangement from davidsides.com, you receive a personal, non-exclusive, non-transferable licence to:
- Print and use the arrangement for your own personal practice and enjoyment
- Perform the arrangement privately
You may not:
- Resell, redistribute, or share the digital file with others
- Upload the file to any website, file-sharing service, or platform
- Use the arrangement for public performance, recording, or broadcast without obtaining the appropriate performance and synchronization licenses from the relevant rights holders
- Claim the arrangement as your own work
Our arrangements
The arrangements sold on davidsides.com are original works created by David Sides. The underlying compositions may be owned by third-party rights holders. Your purchase grants you a licence to the arrangement only — not to the underlying composition.
Accounts
You are not required to create an account to purchase from our store. If you do create an account, you are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
Pricing and payment
All prices are listed in US dollars. We reserve the right to change prices at any time. Price changes do not affect orders already placed.
Payment is processed by Shopify Payments. We do not store your payment card details.
Prohibited uses
You agree not to use our store to:
- Violate any applicable law or regulation
- Engage in fraudulent activity
- Attempt to gain unauthorized access to our systems
- Scrape, copy, or reproduce our catalog or content without permission
Disclaimer of warranties
Our store and products are provided "as is." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.
Limitation of liability
To the fullest extent permitted by law, David Sides Enterprises, Inc. will not be liable for any indirect, incidental, special, or consequential damages arising from your use of our store or products. Our total liability for any claim arising from these terms will not exceed the amount you paid for the product giving rise to the claim.
Governing law
These terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of Alameda County, California.
Changes to these terms
We may update these terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of our store after changes are posted constitutes acceptance of the updated terms.
